| Toxic Torts (1940) | |

A considerable amount of litigation now arises out of claims of harm alleged to result from exposure to toxic and hazardous substances. Typically, this litigation raises many interesting questions in several different but related areas of law, requiring the lawyer to integrate his or her understanding of both substance and procedure. This course will focus on several of the substantive and procedural subjects that typically arise in "toxic torts" disputes. It will encompass the main theories of liability that are encountered, including negligence, strict liability, and products liability, and the defenses to those claims. It will also cover several related topics in: insurance law, especially liability coverage issues; civil procedure, particularly issues involved in mass, multi-party litigation; and evidence, including use of experts. |
